Discussion Of The Equity Principle’s Evolution In Consumer Protection Law Of China

Equity principle originated from equity ideology in philosophy, which was most notably reflected in equity law in the UK. Equity principle is the inherent logic to improve the law. The creation of equitable rights and remedy measures are two ways that to improve the law according to equity principles. The inherent requirements of equity principles are the pursuit of fairness and justice, and to promote the harmonious and orderly rule of law. The forming of consumer protection legal system can reflect equity principle’s evolution definitely. With the development of consumer rights’ protection, equity principle defines consumer rights in the legal level, and it also well protects them through the way of remedy measures. China’s first Consumer Protection Law was introduced in 1993, and it was first revised after 20 years’ enforcement. Compared against the old law, the new law makes some necessary improvement, which also reflected equity principle. In order to improve and make development of our Consumer Protection Law in the future, the legislators can do so me work from pursuing the equity of rights and remedy measures. In this way, the consumer protection legal system can be able to adjust itself and meet actual needs.
