The Protection Of Copyright In We Media Environment

As smart phones and We Media such as WeC hat becoming more and more popular, the hysteresis quality of conventional copyright law protecting copyright of works becomes appearing, which makes the conventional copyright law suffer great impact. The protection of copyright in We Media environment is a new topic with the development of Internet and We Media. This article introduces the concept of We Media firstly, and then defines the concept of copyright in We Media environment is not a legal concept and it has three features different from conventional copyright, while the copyright in We Media environment and conventional copyright are the same in essence. When discussing the relevant basic theoretical problems of copyright in We Media environment, this article thinks the object of copyright in We Media environment should apply to the relevant regulations and requirements of works protected by conventional copyright law. It also analyzes the regulations and features of information network dissemination right and reproduction right in We Media environment. What’s more, it introduces some related contents and regulations in our country about two restricted systems of copyright, including fair use system and statutory license system. Next is the important part and it analyzes the status of copyright in We Media environment. It summarizes four problems of nowadays legal system including temporary reproduction and fair use system and statutory license system and collective management system after analyzing a case about the copyright of WeChat and some related problems about WeChat nowadays in We Media environment. This article discusses the legislation and judicial practices of some foreign countries basing on the four problems above, and then summarizes some useful legislative and judicial experiences for our country about how to improve the four problems. In order to solve the conflicts arising from We Media environment and protect right holders’ copyright and improve the legal system of copyright protection in our country, this article finally presents four suggestions about improving copyright in We Media environment from reality after learning from foreign countries, including formulating appropriate temporary reproduction suitable for reality; using flexible legislation mode to regulate fair use system; broadening the range of application of statutory license system and establishing collective management system.
