Study On The Legal System Of Land Reclamation In China

Land reclamation has become a popular way of many coastal cities to solve the shortageof land, leading to a boom in land reclamation in recent years. With the rapid development ofland reclamation, the legal system of land reclamation in China is not perfect that raises somequestions, such as the program of "sea change land" is unreasonable, the standards of the feesfor the use of sea areas is unreasonable and so on. These issues are attracting people’sattention increasingly. Due to the lack of scientific legal system, not only the property ofreclamation will be difficult to be protected, but also the conflicts between land reclamationand rights of interested parties are difficult to resolve. Thus improving the legal system ofland reclamation is very important to the sustainable development of land reclamation.In this paper, the legal concept and characteristics of land reclamation are the basis.Thenin accordance with Law of the Peoples Republic of China on the Administration of the Use ofSea Areas and other laws and regulations, analyzes the legal system of land reclamation inChina, such as the property registration systems, the systems of the fees for the use. Inaddition, combines with the experiences of Japan, Korea, Hong Kong in this area, in themeantime, in order to discuss the transformation of rights, the process of the right to use ofsea areas changes to the right of use of land will be analyzed. Finally this paper will givesome advises to improve the legal system of land reclamation in China.
