The Research On Improvement Of Legal Institutions Of China’s Secur Ity Advisory

The Security advisory service is one of the basic business forms of the securities investment consultation and the indispensable star business to mature securities markets. The development of Security advisory service is not only beneficial to the prosperity of the market, but also to guide investors to invest rationally and enhance the education of the investors. However, the business suffered ills such as the cases of investors’ interest(damaging the interests of the investors) occur frequently.From the perspective of legal institutions, the author holds that the construction, integration and practice of the concrete system, these three aspects which concludes administrative supervision, self-discipline and recovery of civil liability are no doubt the key for the relevant legal system of the securities investment consultation. This article planned to find the defect of the current system through research the current system and practice of the above three aspects in our country with comparisons method and empirical analysis, in order to put forward a solution which contributes to improving the legal system of Security advisory service in China.According to this thought, this paper made the following arrangements in layout: the first part traces the development of the Security advisory service in our country and explores the existing problems in securities investment consultations. According to the existing problems, the second part is to find relevant defect in current legal system of securities investment consultation and make a comment based on the work in last part. For the study of the legal system, the author has made a classified process firstly that divided the legal system which is researched into two parts: the administrative supervision system and the judicial system of accountability. In the aspect of administrative supervision system,this paper focuses on defect studies of the legal system about the relationship among the operation control models, regulatory measures, law enforcement mechanism, and administrative supervision and self-regulation of the Securities investment business in our country.
