With the improvement of economic development level, begin to enter the stage of high-speed urbanization in our country, this one phase highlighted the farmers problems from the agricultural society to industrial society, these problems are in part caused by urbanization,and at some stage will hinder the development of urbanization in China. To solve problem of farmers in urbanization is not only for the high speed development of urbanization to eliminate obstacles, but also can make more urbanization with high quality. This will also conform to the party and the government have been make farmers problem as the first question of policy, the policy of our country. And the peasant problem on the surface is complex, such as land lose, life security system, farmers in city, etc, seems to be difficult to find a effective and permanent solution. And these problems we can be attributed to the rights, it is because the farmers’ rights protection does not effective, will appear all sorts of farmers’ problems in urbanization. in order to fundamentally solve this problem, we must from the perspective of right to solve the problem of farmers. Hope with the help of cultural diversity theory, this paper is an attempt to analyze from the perspective of rights to farmers, through cultural diversity theory guidance to find the legal way to solve the problem.This paper will be divided into three main parts, its basic frame and main content is as follows: the first part starts with the basic concept and development of cultural diversity theory, this paper introduces the concept of cultural diversity theory definition. Points out the culture diversity theory is used to measure the basic principles of farmers’ rights protection, and put forward the regional rule of law as the rule of law tools, through the theory of regional rule of law to carry out the cultural diversity of farmers’ rights protected by law. The second part is a sampling of the cultural diversity that farmers should enjoy rights and the lack of rights issues. Then, by the lack of farmers’ rights and cultural diversity measure of farmers’ rights protection principle proposed to improve the farmers’ rights protection issues of theoretical knowledge. Article third part puts forward perfect the legal measures of protection of farmers’ rights, this paper introduces the foreign experience and lesson in the area of the rule of law that, put forward through the protection of traditional villages and traditional skills such as to implement the farmers the right of choice, the right to development, compensation and other rights, and establish and improve the legal system of protecting farmers’ rights, to carry out the farmers’ rights, prevent law for its absence.
