Improvement Of The System Of Releasing Judgment Document

This dissertation plans to analyze the reasons, the current status and the defects of the public systems of judgment document release in China. At the same time, some suggestions are made to improve the judicial system. The presents of releasing judgment document is that,the basis of release is becoming more specific; the standard of release is becoming more clear; the platform of release is becoming more integrated; the type of release is becoming more comprehensive; and the attitude of release is becoming more initiative by empirical methods.The judicial system in China presents the following feature: lacking authoritative, systematic and scientific prescriptions by tracing back to the origin of the judgment document release system and by using the comparative analysis methods between the existing judicial system in China and western countries. It also describes the system defects which are mainly caused by traditional thoughts, following of sense of entitlement, the restrictions of the Code Doctrine,insufficient judicial resources, and less operability of normative documents. Then the dissertation provides some suggestions to improve the release system in China through referring to both domestic and foreign judicial policies as well as the author’s court work experiences.,as the following several aspects:the legislature should strengthen the authority and uphold justice;the policy making process should be scientific, reasonable and standard; there should be more supervision, effective constraint, and clear responsibilities on implementation side; more stable relief mechanism needs to be built, etc.
