On The Principle Of Opening Criminal Trial

The people’s courts have comprehensively deepened judicial openness,and strengthened the construction of four open platforms for trial processes,court trials,judgment documents,and enforcement information.Criminal cases entering the trial stage can be divided into three stages,that is,the trial publicity is divided into three aspects: pre-trial publicity,publicity of the trial process,and publicity of judgment documents.There are certain problems in all aspects,and the trial process is open:(1)there is a conceptual confusion between the disclosure of criminal trial process and disclosure of criminal trial process information;(2)the scope of disclosure of criminal trial information is narrow;Public irregularities,etc.With regard to the live broadcast of criminal court trials,there are still legislative gaps,incomplete live broadcast court trials,key and difficult cases,and cases with high social attention in China.Remaining problems in the disclosure of judgment documents include:(1)some Internet access to criminal judgment documents;(2)the exceptions to the disclosure of criminal judgment documents are incomplete.Through the analysis of the above problems,the author puts forward solutions such as constructing a platform for the disclosure of information on the trial process,improving laws and regulations for the live broadcast of court trials,and improving technical control measures for the online use of criminal judgment documents.The principle of open trial of criminal cases in our country has been continuously improved since its introduction.If the existing problems can be solved,the principle of open trial of our country will be developed more effectively and the judicial credibility will be guaranteed.
