The Research On Management Of Case-related Vehicles In Guangzhou Traffic Police Department

On November 4, 2010, the Ministry of Public Security issued Relevant Provisions On Case-Related Property Management For Public Security Organs. The public security organs across the country and the theory circles, in combination with the articles and clauses concerning criminal case-related property in the Criminal Procedural Law of the People’s Republic of China, made some theoretical research and discussions thereafter on case-related property management in the criminal law enforcement process. But due to lack of specific laws and regulations on managing case-related property, for particular, the case-related vehicles in the traffic control department, in the administrative law enforcement links, and the relevant regulations and standards are not explicit enough. Therefore, the theory research on case-related vehicles in the traffic police department is far from satisfaction.The case-related vehicles in the public security organ refer to the vehicles temporarily seized by this department routinely for traffic violation handling or for traffic accident investigation and evidence collection purpose in the administrative law enforcement link. This kind of management operation involves many managing links, a great deal of property and long storage time. In addition, there are no explicit provisions for post-disposal of the property. It has always been a difficult link in traffic administration of the public security organ and one of the hot issues of concern to the masses of the people and the society.This paper mainly uses the literature analysis approach, the empirical research method, the comparative analysis method and etc. to make research in the following aspects: Firstly, expounding the background and the background and significance of case-related vehicles management in combination of the current social situation and the pace-keeping requirements of the times. Secondly, analyzing the existing problems and weak links in the current management systems and practice. Thirdly, proposing a series of oriented solutions to case-related vehicle management and theoretical discussions, which is the focus and the core of this paper.
