The Study Of Relationship Between The Judicial Justice; Judicial Efficiency

Justice is the primary requirement of the legal state, also the last defense of social justice. In recent years, miscarriages of justice occurred, one of the reasons is that the performance evaluation of judges too much emphasis on the standard of judicial efficiency while ignoring the fair administration of justice, which produce the wrong guidance function to the judicial activities of the judges. The author hopes this article can write on the relationship of readjust to the depth between the judicial efficiency and justice, research performance evaluation criteria of the judges and reform the judges performance evaluation standards, promote the pursuit of justice in the administration of justice in the maximum value from the judges performance evaluation aspects, that is,to improve judicial efficiency and achieve fair and efficient administration of justice under the premise of ensuring justice.In addition to the introduction, this paper is divided into four chapters: justice and judicial efficiency index analysis, study of judicial efficiency and justice, judicial efficiency and the relationship between justice and countermeasures and suggestions to improve the performance appraisal system of judges.In this paper, the introduction summaries the points of relationship between judicial justice and judicial efficiency on the domestic and foreign. The first chapter researches Feicheng grassroots people’s courts and the Shanghai Second Intermediate People’s Court, analysis the relevant data about performance evaluation of judges justice and efficiency indicators, to put too much in pursuit of judicial efficiency ignores justice of the case. The second chapter mainly study the connotation of judicial justice and efficiency, assessment criteria and indicators for each share of the weight. The third chapter analysis the four quadrants of the state of justice and judicial efficiency using the methods of graphical overview: efficient and unfair state, inefficient and fair state, inefficient and injustice state, in which the efficient and fair state has always been the goal we should pursue. when the efficient and fair state is difficult to achieve, it should be to pursue inefficient and fair state, while theefficient and unfair state and inefficient and injustice state should be discarded during the judicial practice. And then, according to four states, the chapter four analyzes and comes to the related countermeasures and suggestions about performance evaluation standard of the judge in our country.
