Research On Non-legislative Acts Of Prosecutorial Abstract Administrative Supervision System

Non-legislative abstract administrative behavior has become an important means of administrative management at all levels of government,the number of government with the need to dramatically increase. But our existing oversight mechanisms is difficult to effectively play its role of supervision and control of non-legislative abstract administrative act has become out of control and abuse of executive power the hardest hit.Therefore, to promote the rule of law in our country,standardize administrative organs according to law, safeguard the legitimate rights and interests of citizens, non-legislative acts of prosecutorial abstract administrative oversight has become a trend. In this context, building supervision system with Chinese characteristics prosecution of non-legislative abstract administrative acts will be imminent. With regard to non-legislative acts of prosecutorial supervision abstract administrative, scholars agree on the non-legislative acts of prosecutorial abstract administrative oversight. This paper attempts a theoretical analysis, and strive to build our country on non-legislative acts of prosecutorial abstract administrative supervision system.In addition to the introduction and conclusion of this article, is divided into six parts: The first part introduces the abstract administrative acts and non-legislative prosecutorial supervision system and describes the theoretical basis of the establishment of non-legislative acts of prosecutorial abstract administrative supervision system. The second part discusses the necessity and feasibility of setting up a non-legislative acts of prosecutorial abstract administrative system. The third part introduces our existing administrative action against non-legislative oversight of abstract patterns and problems. The fourth part describes the two legal representative of several national prosecutors abstract administrative action against non-legislative oversight and the main way of non-legislative acts of the abstract administrative oversight. And analyzes the advantages and disadvantages of the Two major oversight model, summed revelation to the construction of acts of prosecutorial abstract administrative supervision system. The fifth part of the above discussion and analysis and learn from foreign experience to build our proposed non-legislative acts of prosecutorial supervision system of abstract administrative system design. The sixth overall summary of the article were that the construction of non-legislative acts of the abstract administrative procuratorial supervision system in China with reality and urgency.
