Research On The Law Risk Precaution Of Contract Management

Currently, global competition is increasingly fierce, the contract plays more and more important role in the enterprise management activities. It not only helps enterprises to obtain economic profits, but also it is the root of all kinds of economic disputes. Just as a Western proverb goes:"half and more treasure lies on contracts".Contract management is a significant part of enterprise management. It is the basic requirement to protect the legitimate rights of enterprises, it is also an important means to govern legal risks.In this paper, I analyze some basic concepts such as risk, contract management, risk precaution, and then, I explain the definition of contract management legal risk, which including the possibility that the enterprises bring losses or gains.Then, I analyze the existing misunderstanding and present situation of contract management based on JXCC Financial Company, and give some valuable suggestions about building suitable risk precaution system as follows:Firstly, cultivate employee’s contract legal risk prevention consciousness;Secondly, improve contract management institutions and set up a system to regulate the responsibility between legal affairs department and other departments;Finally, emphasize the strength of informatization of enterprise contract risk managment, and further demonstrate informatization has become the inevitable trend of the future contract management.So,it is the urgent trend to discuss the contract law risk management and precaution of enterprise group financial companies at present.
