As a new form of punishment, community correction is very important for the whole society. The humanized settings, the highlight of the humanity value reflects a spirit of tolerance, the ultimate goal to criminals return to society with human nature. Community correction has been relatively mature and perfect in the western countries since the implementation of the United States. As a whole, the foreign community correction has its systematic construction, and the corresponding legal protection is relatively complete. In China, the promotion of community correction system has been carried out for many years, and the results are quite good, but the public is relatively new to it.The provisions of the laws of this stage of the community correction is too scattered, scattered in various provisions of administrative regulations in too principle. China is lack of a special legislation on the implementation of community correction system to make specific provisions. On 24 February 2015, the office of the State Council issued the implementation plan of deepening the reform of the judicial system and the social, announced in 2015 to promote to develop the community correction method, to the community correction contents and procedures to further clarify. The reform and innovation of community correction is gradually valued. China’s community correction of specialized legislation can make a unified guidance to the work process, and then give a strong legal guarantee to solve the problems in judicial practice, the legislation lags behind.This paper mainly consists of four parts. The first chapter is the formal beginning of the whole thesis, which mainly introduces the purpose and significance of the research, analyzes the current situation of domestic and foreign research, and points out the shortcomings of the theory and empirical research. On this basis, a clear article to solve the problem and innovation. The second chapter analysis the plight of executing the law and civil system and the weak awareness of community correction, points out the current law enforcement of law enforcement personnel shortage, body is unknown, the lack of professional problems, at the same time, it points out the severe penalty doctrine of entrenched and citizens of the system itself is not enough to understand the problem. The third chapter analyzes the reasons of the problems of community correction system in China, including the lack of the legislation, the specific procedural requirements, and the lack of the investigation and assessment. The fourth chapter puts forward the countermeasures and suggestions to improve the community correction system. To improve the implementation of community correction system in China, we should strengthen the legislation and supervision, standardize the community correction institutions and staff, and improve the system of pre-trial investigation and evaluation, in order to build a unified coordination of local community correction system, and give full play to its expected effect.
