The Ways To Improve Jury System With The Background Of The Judge Responsibility System

Judicial reform is a systematic project and the systematic character of the judicial reform results in "pull one hair and move the whole body" chain effect. Reforming measures which target at particular aspects instead of the whole judicial system is likely to prevent the reformfrom reaching ideal effects because of other unchanged aspects of the judicial system. Our country is now focusing on judicial reform and separation of administration and judiciary is particularly necessary in order to reach the goal of the judicial reform. The separation requires two aspects of innovation:Judge Responsibility System and Jury System. As the results of imitation of western judicial system, Jury System is still faced with loads of problems to settle in order to adjust to the whole Chinese judicial climate. What should we do to improve Jury System in order to coordinate with the whole judicial system, enhance people’s trust in judicial system and finally reach the goal of the judicial reform is of very importance. Therefore the dissertation is to explore the ways to improve Jury System with the background of the Judge Responsibility System.The dissertation starts with the notion, significance and the interrelationship of Judge Responsibility System and Jury System, and then the second chapter will describe the problems of current Jury Policy from three aspects:the behavior of people’s assessor, the indecent conduct and the management of the Judge. The third part focuses on the positive and negative aspects of the influence of Judge Responsibility System on Jury System. The forth part is going to give general ideas and particular suggestions of improving Jury System within the context of Judge Responsibility System in order to settle the current problems mentioned above.
