Judicial Credibility

Judicial credibility is an important indicator for society with rule of law, and it is the cornerstone of the judicial system and the momentum source of judicial development. With the rapid transformation of our society, from the economic system, economic operation, subjects of social interests and the distribution relationship closely related to the subjects, people's lifestyles, ways of thinking, to the values, profound changes have taken place, showing a variety of development trend. Growing awareness of people's rights, their aspiration of rights has become even more intense. Moral anomie in the social environment, the social credit system breakdown, the judicial system is also confronted with credit crisis. Currently, excessive delay in the proceedings, the high cost to achieve justice, unfair verdict of the individual case, judicial corruption, etc. make people suspicious of the judiciary, judicial credibility crisis becomes an unavoidable fact in theory and practice. Judicial has lost trust and confidence of the public. Judiciary without credibility is like a tree without roots, it will seriously restrict the development of our judicial process. In 2008,atthe beginning of the in-depth studying and practicing the scientific concept of development activities, the Supreme People's Court putted forward the "strict rule of court, credibility to be the fundamental, strengthen court through science and technology " approach, which " credibility to be the fundamental " is the core content.This paper took the judicial credit crisis in transition as the entry point, under the context of rapid social transformation ,social credit system disorders, and the socialist concept of rule of law in depth, interpreted the credibility of the concept of judicial from the start, clarified the meaning and significance of judicial credibility, analyzed the supported structural elements of the credibility of justice, then started from the lack of the credibility of justice, in the perspective of inside and outside the court system, analyzed the system and idealistic causes of the low credibility of judicial credibility, and then booted from the system improvement and the concept of two aspects, to explore the path of upgrading our judicial credibility and build the ideal picture of judicial credibility.Chapter 1 topics the background of this article, current situation and the purpose and significance of research reviewed, so as theoretical groundwork to depth study of judicial credibility. Chapter 2 defines the basic issues of judicial credibility: first, to clarify the credibility and the credibility of justice, then summarizes the meaning and definition of judicial credibility. Second, start from the essential attribute of judicial power, analyzes structural elements supporting the credibility of justice, pointed out that the authority, impartiality, openness, efficiency formed the judicial credit system; Chapter 3 started from the performance of the lack of judicial credibility, through the interpretation of the Related material, analyzed the causes of the lack of the judicial credibility; Chapter 4 developed the concept of shaping judicial credibility and picked out measures from the system improvement and idea guidance. System and the idea of two kinds of measures to integrate with each other, promote each other and jointly promote the enhancement of the credibility of our justice.
