The Empirical Research On Minors Sexual Assaulted Crime In China

In recent years, the sexual abuse of minors cases have occurred frequently which have attracted broad attention about sex safety of juveniles, for example, Dong Qi slipped into the middle school dormitory and raped six female s tudents, an elementary school principal ravished nine girls in Anhui Province. Due to the physiological and psychological immaturity and lack of sex awareness, juveniles easily suffered from sexual abuse. Molestation brings physical and psychological trauma to the victim, even more serious is the fact that the victim may live in the shadow of the murder for a long time. Molestation has seriously affected the healthy growth of minors and damages the legitimate rights and interests of the minors.The purpose of the article is to help the protection of legal benefits of juveniles and to prevent minors being suffered from sexual assault. The article attempts to study from the perspective of minor victim. Literature analysis method, case analysis and comparative research are used in the article. At the same time, 121 written judgments about the crime of child molestation and 68 written judgments about the rape are used to analyze the data. Its purpose is to sum up the characteristics of minors suffered from sexual abuse and analyze the reasons of the juveniles were abused. The measures and suggestions to curb these problems are put forward. This article mainly expounded from four aspects.First of all, in this paper, I need define the basic concepts about sexual assault of minor crime victims. The age of minors is defined, and the concept of minors, and children and female are compared for distinction. By studying this, I define the specific scope of the sexual abuse of minor crime victim in this paper. And then, I analyze the detriment of the sexual assault on juvenile victim, the victim’s family and society. For minors, sexual assault is damage to their physical and mental health. For the family, sexual assault is harmful to the family harmony. For social, it is bad for the construction of a harmonious society.Secondly, the article summarizes the characteristics of minors suffered from sexual abuse through analyzing 121 written judgments about the crime of child molestation and 68 written judgments about the rape. With the increasing number of sexual assault cases, it has become increasingly apparent about the victims’ age younger and younger. Sexual abuse occurs between acquaintances a nd it also has concealment. The infringer of sexual assault is accidental. Means not only include the violence and threat, but also lure. The injury of multiple organ and mental is serious, while the compensation is deficient. There is a lot of recidivisms in the middle of the infringers.Thirdly, the paper discusses the reason of sexual assault crime from the perspective of the juvenile victim, the infringer and social. Owning to the young age, less understanding of sex knowledge and the lack of cognitive capacity, the juvenile are easily being hurt. For the infringer, the main reasons of they carry out sex crimes are low literacy, lack of legal consciousness and the poor of self-control ability. At the same time, they may think juveniles are easy to contro l. From the social point of view, four factors have being increased the incidence of sexual assault crime. Such as, the negative social cultural, the late of judicial process, the legislative defects, and the insufficiency of public security management in rural area.Finally, suggestions on the sexual assault crime management are put forward. We can take a series of measures to protect minors’ safe sex. Perfect legislation and strengthen legal protection. We can expand the protected object and behavior pattern of the rape crime. Improve the system and innovative management of sex offenders. Perfect the provisions of the law on the crime of child molestation. Establish and perfect our country’s sex offender registration system. Take the spirit of underage victim damage into the scope of compensation and establish the national compensation system. Strengthen the minor crime victim psychological counseling of sexual abuse. Protective violate the privacy of minors crime victim. Improve the system of recidivism and cohesion with security measures. Strengthen the systematic education. Build the integrated security system. All of the above measures can reduce the infringement cases and can create a harmonious environment.
