Research On Legal System Of Chinese Museum Management

The history of Chinese legal system is a field that needs to research, it has very important position. As one important part of the history of Chinese legal system, scholars pay little attention to this field. Recently states-owned museums and private museum’s development, museums have to be faced with a new surroundings and transformation in inner management. In the meantime, it also asks that museums should clear the definition of museum’s legal qualification for the main body when in the process of market economy and building a legal state, then clear their right and duty when in the process of internal management and external exchange. Thus, it plays an important role to clear the legal system and legal idea of museum, so as to protect the historical relic and collections of museum.By using historical analysis method, value analysis method and empirical analysis method, this paper study the content of legal system of Chinese museum management, which is based on the evolution of legal system of Chinese museum management. It also clears and defines the characteristics of legal system of museum’s management, highlights the value of legal system of Chinese museum management, then contraposes the insufficient of legal system of Chinese museum management, puts forward the corresponding measures, so as to promote the development of museums healthy and orderly.The paper consists of five parts:first of all, part one states the importance of the history of Chinese legal system, clear the purposes and significances of research on legal system of Chinese museum management, then it introduces the current theoretical perspectives and research achievements in educational circles briefly. Then it clears the focus and directions of museum research, so as to do some foreshadowing for the below.Part two teases the evolution of legal system of Chinese museum management in detail. To emphasize the different characteristics of legal system of museum’s management, the author clears the evolution on three aspects, they are legal system of Chinese museum management institution, legal system of Chinese museum management function and legal system of Chinese museum collection management, so as to show the feature of the evolution of legal system of Chinese museum management. Based on different features of legal system, the evolution is also different in stage division. The evolution of legal system of Chinese museum management institution based on different stage of social development as the division standard, the evolution of legal system of Chinese museum collection management based on the course of reform of economic system as the division standard, the evolution of legal system of Chinese museum management function based on its self-development as the division standard. The evolution features on its systematization, internationalization, continuity, innovation, containment and independence, shows the characteristics of legal system of museum’s management.Part three mainly analyzes the content of legal system of Chinese museum management. This part describes the legal system of Chinese museum management institution, museum’s management function, museum management on collections and museum’s personnel management, which is based on the definition of museum’s legal qualification for the main body, so as to clear the system of legal system of Chinese museum management.Part four mainly discusses the characteristics of legal system of museum’s management, the legal system of museum’s management features on multiple levels, sociality, openness and profession, understanding those characteristics contributes to clearing the development direction, so as to achieve the goal of museum’s good and fast development.Part five evaluates legal system of Chinese museum management objectively. Author believe, it has great realistic significance to the production of legal system of Chinese museum management, this production contributes to standardizing museum management, optimizing the structure of the system of museum, ensuring the basic right of citizens, realizing the legal value of museum, promoting museum’s legalization and culture’s diversification. However, the legal system of museum management has some insufficient, the department concerned should pay more attention to it, we should enact museum law as soon as possible, set up specialized scientific research institution, build up talent team, realize the sustainable development of the collection, further improve the museum staff professional ethics laws and regulations, strengthen moral binding, promote the development of museum business prosperity.
