With the China’s economic prosperity and the rapid growth of the urban population, the development of the real estate industry is very fast. That leads to the high-rise development trend of the building, and residential property has become the most common form of residence. Thus, the condominium ownership system gradually began to be everyone’s concern and attention. It is a unique complex of rights, and includes the exclusive right to the proprietary part of building, the right to the public part of building and the right of the members of the public parts produced.In the above three types of rights, from the reality of the case of distribution, a large proportion of dispute focuses on the co-ownership. Although the "Property Law", "Judicial Interpretations Of Property Law" and "Building Service Management Regulations" has provided some legal basis, but due to the special nature of their co-ownership and the lack of legal awareness of their own, co-ownership causes disputes frequently in daily lives. Although the co-ownership of the article more, but studies done mostly on the basic theory of co-ownership. This paper from the theory and practice of view, and on the basis of real case and the legal status of lack of co-ownership protection, finally to propose effective protection measures and recommendations.The full text is divided into four sections, and has a total of twenty thousand words.Part one introduces the basic theory of co-ownership of condominium ownership, including the co-ownership of the nature, scope and object definition and specific content, and provides a theoretical basis for the following parts.Part two analyzes the lack of protection of the actual situation of co-ownership of condominium ownership. From the subject and the specific behavior against the co-ownership, so obtain the importance of co-ownership for protection.Part three combines the content of the second part, and analyzes our co-ownership laws and shortcomings related to the protection.Part four according to the analysis about the lack of protection of the right to the situation and the lack of laws, this paper proposes the appropriate legal measures and suggestions to protect the co-ownership.
