Since the 1980s, the rapid development of Chinese society, urban residential areas have sprung up, these residential areas have changed people’s way of life and way of living of the original, neighborhood relations between people also change subtle. In order to creating better living conditions for the building owner, autonomous organizations in the districts are also gradually emerging. The autonomy of this residential area is basis on the condominium ownership, and it implements management activities in accordance with strict provisions of laws and regulations in the public domain, to establish autonomous organizations, to exercise autonomy, and to undertake self-management activities.Based on the theoretical basis of condominium ownership, the author discusses the basic theory of co-ownership, and then expounds related concepts and theories of the boy of the exercise of right-the owners and autonomous organization of owners at last, a series of questions of the right in the process and use are raised, and countermeasures are proposed. Overall, this paper is divided into five main sections:The first part of the article describes the theory of condominium ownership and co-ownership, to understand and demarcate condominium ownership from different angles, and comes to the conclusion that condominium ownership is obtained by the exclusive right, the right to co-ownership and membership. Then the author introduces the standards of definition and the scope of co-ownership; The second part is to parse basic theory of autonomy of the owners, including the concept and range of autonomy of the owners; The third part discusses the boy of the exercise of co-ownership, including two categories:owners and its autonomous organization. and the author separately analyzes the rights and obligations of the owners, branches and its legal status of the autonomous organizations of owners; The fourth part is to introduce the status and problems about the exercise of co-ownership, including the owners and the autonomous organizations, which focuses on the plight of the laws, practices and this theory of collective action dilemma of owners’autonomous organization; The last part is entitled to propose some targeted protection measures for a total of problems in the process of the exercise of co-ownership. In accordance with the analysis and arrangement of structure in the previous article, the first countermeasure is to raise remedies of co-ownership for owners, and to put forward protective measures about exercise of co-ownership for autonomous organizations as the other countermeasures. I hope those countermeasures is beneficial to cognitive the theory of co-ownership and better protect the exercise of co-ownership, promoting owners’ self-government organization better development, and creating a better environment for residential property owners and the order of autonomy.
