On The Improvement Of Credit System Of Socialized Forensic Science Institutions

"The decision of standing committee of the National People’s Congress on the judicial authentication management issues "(here refers to as the" Decision ")generalizes the forensic science institutions (FSI) set up in the investigation organizations and approved by the judicial administrative authority. This paper uses the word "social" before the Forensic Science Institutions to make it clearer for readers. It only refers to the authentication institution that approved by the judicial administrative authority.After the socialization of FSI, lots of incredibility cases appear in our country due to the lack of effective administration for specialized management and forensic science association. It not only exhibits inauthoritative and unserious expert reports but also causes sharply declination of the social judicial credibility in FSI. Moreover, the situation reduces the efficiency of lawsuit. The unauthentic expert reports result in wrongful conviction and damage innocent peoples’rights seriously. Thinking of the factual issues, the author thinks that we should develop gradually to strengthen the social credit system for the FSI. This paper tries to use the method of case analysis to discuss and analyze the improvement of current credit system of socialized FSI. It is the hope that the proposals are constructive for the credit mechanism of judicial appraisal reform.This article includes four parts:The first part introduces meaning and the value of credit system in FSI. The author states the concept of social judicial credibility of FSI, and then illustrates social judicial credibility system in FSI from three aspects, self-discipline supervisional system, the social supervisional system and legal system. Moreover, the author emphasizes the value of social judicial credibility in FSI.The second part analyses social integrity problems within social judicial credibility system of FSI. The current social integrity problems are extracted from four typical cases. Then the article analyzes the cause of these problems and the basic reason is the lack of credit system.The third part researches the lack of social judicial credibility system in FSI. This author describes three aspects as FSI in legal system, self-discipline supervision system and social supervision system in order to analyze the reasons of lack of integrity system.The fourth part advises the methods for perfection of social judicial credibility system in FSI. Firstly, it is the most important thing to improve the legal construction of integrity system in social FSI. Secondly, it is very critical to strengthen the self-discipline mechanism in FSI, to develop the professional quality, and to and to advance the surveyors’abilities, as well as to strengthen the self supervision of social FSI. Thirdly, it is significant to enhance the supervision system of the social FSI:to strict the system of professional qualification for surveyors in FSI, education and training, regular assessment, incentive and punishment management, and to enhance external supervision from administrative authorities, industry associations, the court, the parties and the public.
