| In recent years, the incidents of violent attack towards police frequently occurred all over the country and are showing a rising trend. As social contradictions aggravate, the methods of attacking police have been gradually upgrading, which turned from insults, invectives, threats, malicious accusations and other mental injuries to sieges, obstructions, assaults, attacks and other physical injuries. According to the statistics of the Ministry of Public Security, since 1980 there have been over 400 public security police officers died gloriously and more than 6,000 police officers got injured due to work in China. That public security police officers suffer from violent attacks has become a rather serious problem in present China. Problems such as how to protect legitimate law enforcement rights of public security police officers, how to effectively check behaviors of attacking police and whether crime of attacking police shall be added have caused the attentions and heated arguments in all the sectors of society.The police, as an important component of state violence agencies and empowered by the state and laws, is the coercive power implemented according to the law in preventing, checking and punishing illegal and criminal activities, and it is also a guarantee for realizing police functions and completing police missions. In addition to direct infringement upon law enforcement rights of public security police officers, the more severe issue lies in that the frequent occurrence of incidents of violent attack towards police directly endangered the ordered management of social public security. The activity that obstructs police from legally performing official business by means of violence and threats damages the law sanctity and authority, infringes the normal activity of state organs which is the object, breaches the social public orders, impairs the normal management of society implemented by the state organs, and ultimately, it infringes the fundamental interests of the vast majority of people. Therefore, how to be on guard against the activity of violent attack towards police has become an urgent issue in nowadays society.At present, the situation that the law enforcement rights of the police officers at grassroots level of the public security organs are infringed is more prominent. And there are many causes, both the influence of factors such as the relatively lagging behind legislation and complex law-enforcing environment and other factors such as the shortage of police forces in public security organs, the lack of standardization in law enforcement of police officers, and lack of safety awareness, etc. In this paper, started with the list of incidents that the people’s police officers are violently attacked during the works in their struggling against enemy, fighting against crimes and maintaining social order, the status quo of violent attack towards police at the present stage was expounded and the systematic analysis of the causes of activity in violent attack towards police was performed. What’s more, by comparison of the countermeasures against attacking police in Europe and the US with those in our country, with an aim at the status quo of the domestic violent attack towards police, it was mainly proposed that the containment of incidents of violent attack towards police shall be conducted in the aspects of improving laws and regulations, building sound law enforcement environment, establishing police rights protection organizations, building harmonious relationship between police and people, and improving law enforcement public credibility of public security organs, etc. |
