Study On The Legalization Of The Power List

Since the central committee officially decided to implement the governmental power list, the power list system has been achieved from the implementation of individual districts to nationwide, it has set off a crazy developing of power list in our country and become the focus of attention. There are many researches on the power list, but lack of the research on the legalization of power list. As an emerging thing, there are still many problems in the power list, we should use the theory of competence as the foundation and improve the power list by means of the legalization.The introduction of this article describe the background and necessity of the major topics. In addition to the introduction and conclusion of the article, the article is divided into five parts,the specific research ideas and design is as follows:The first part is the basic theory of the power list. At first, this part expound the origin and development of the power list, and then to define the concept of power list. Finally, this part explain the meaning of power list in four aspects:power list is the important result of administrative reform, power list make the operation of power known to public, power list can prevent the corruption of power from the source, power list can control and regulate the government authority effectively.The second part is to conduct field investigations on power list in Fuyang city of Zhejiang Province. We obtained from the field investigation that the making bodies and staff situation of the power list in Fuyang, the release and manifestation of power list, the division basis and the kind of power list, the purpose and effectiveness of the power list.The third part is to analyze and demonstrate the contents of the field investigation in Fuyang city of Zhejiang Province. Firstly, we found the basic problems of the power list through the analysis of the field investigation. Secondly, we try to analyze the main problem of the power list. At last, we conclude that the main problem of the power list is lack of legalization.The fourth part discuss that the key to the legalization of power list is to make the power list from the theory of competence. Then we analyze the relationship between power list and the theory of competence clearly, Finally, we introduce the theory of competence and kompetenznormen.The fifth part is the solution to the problems of power list by legalization means. We can improve the legalization of power list by establishing the administrative competence norm system, accelerating the special legislative work of power list, constructing the supervisory mechanism of power list, building up the supporting system of power list. We expect these measures will be helpful to the development of power list, and then can promote the construction of the law-based government and country.
