Study On The Legalization Of The Administrative Power List

The Administrative Power List System is an innovative measure to restrict the administrative power of government and realize the transparency of government power.In the process of concrete practice,there are many problems in China's the Administrative Power List System,which is rooted in the low degree of legalization.It is necessary to carry on some of researches of the policy and improve the legalization of it by completing the measures that is able to constrain the administrative power of the government,for making the policy become a long-term system of Chinese characteristics and success in building a country ruled by law.Excluding the Introduction and the Conclusion,there are three section in this paper.The research process and design thinking can be listed in the following:The first section is the summarization of the Legalization of the Administrative Power List System.On the beginning,I define the conception of the Legalization of the Administrative Power List System and it's legalization.Then I introduce in detail it's three principles.Lastly we state the signification of the Legalization of the Administrative Power List System from four aspects,such as controling and regulating the power of the government,simplifing administrative procedures delegate powers to lower levers,comprehensively improving local rule of law and reinforcing the administrative legal sense.The second section is the study on the practice situation and the problem of legalization of the Administrative Power List System.There are five questions summed up through the analysis of the practice situation of legalization of the Administrative Power List System.Firstly,laws and regulations cannot keep up with social needs;Secondly,the list of powers lacks clear legal status;Thirdly,the list of powers lacks a unified production standard;Fourthly,the establishment of the power list is not perfect;Fifthly,in the construction of the system,the monitoring mechanism and the mechanism for accountability of the power list is not imperfect.The third section is to propose the corresponding suggestion strategy for the problem of legalization of the Administrative Power List System.Firstly,make and perfect relevant laws and regulations;Secondly,larify the legal status of the Administrative Power List;Thirdly,work out uniform standard for making of the Administrative Power List.Forthly,perfect production procedure of the Administrative Power List System.Fifthly,complete the monitoring mechanism and the mechanism for accountability of the legalization of the Administrative Power List System.
