According to the Chinese central bank announced "the overall situation of the payment system in the first quarter of 2015", the data show that as of the first quarter of 2015, the national credit card in the amount of 424000000. The Chinese central bank announced "the overall situation of the payment system in the 2014" shows that the average cardholder has reached 1.70 and 1.33 in Beijing and Shanghai.These data proved the popularity of credit cards has already expanded a lot, credit card has become an important part of promoting the construction of social credit system in China, but the credit card defaults are increasing sharply. In 2013,the chinese banks occurred so-called "shortage of money", a number of large state-owned banks participated in the interbank and other "borrow" behaviors.the social capital, Internet P2P finance platforms and the folk lending became popular.the behavior of "cashout" which was one kind of credit card defaults became an important source of funding for private financing, caused a large number of default risk events. In this thesis, a comparative study will be apllied which includes the law system of credit card in the United States as a comparison object. To find out suitable legal norms for current China’s credit card market and control the credit card cash default behaviors by compared with the Chinese credit card cashout defaults and legal norms.
