Research On The Legal System Of The Full-covered Budget Supervision

One of the basic principles of the budget law, the comprehensive and complete budget, which derived to the "Full-covered Budget" is the foundation of the modern state public finance management, but also the democratic budget and the rule of law under the background of public finance. But for a long time, China’s public financial capital management has a large amount of extra-budgetary revenue and expenditure, the budget supervision also presents the characteristics of fragmentation, the full-covered budget legislative level of supervision and control is very weak, to the national economic, political and social health development cause a big obstacle. Therefore, it is urgent to strengthen the supervision of the full-covered budget, and further improve and perfect the legal system of budget supervision.This paper begins with the concept of full-covered budget, and describes the meaning and specific content of the full-covered budget. Next, this paper discusses the general theory of the full-covered budget supervision, and redefines the concept of the full bore budget supervision, and expounds its theoretical basis and basic legal system. Subsequently, the article analyzes the current situation of the implementation of China’s full-covered budget supervision, and emphatically discusses the problems in the full-covered budget supervision:budget supervision legal system is not perfect, the budget supervision system is not comprehensive, unbalanced, the full-covered budget system is not perfect, the budget supervision failed to achieve the whole process of control. At the same time, the perfection of the legal system of full-covered budget supervision is put forward:(1) perfect the legal system of the basic finance and budget supervision; (2) improve the internal and external supervision system of the full bore budget, which is mainly based on the People’s Congress Supervision; (3) expand the scope of the budget supervision; (4) improve the procedures of budget supervision and public budget. Through these measures, the implementation of effective supervision from the full-covered budget system, the whole process of the budget and the ultimate realization of the government’s public budget behavior restrict and control, the target of the full-covered budget can be gradually realized.
