Study On The Standards And Allocation Of Compensation For Land Expropriation In China

The legislation of land expropriation has an important position in the whole legislation system of land around the world. In the 20 th century, the pace of the reform for land expropriation system in China has been speeding up apparently. Under the current framework of land management system, the reform for land expropriation system has continuously improved, basically adapted to national conditions and special development stage, and provided an important support for the rapid development of economic society. With the deepening of the urbanization progress, China enters the period of social transition and contradictions. The consciousness of public rights has gradually strengthened, and the interests demand has also diversified, which makes the contradictions triggered by land expropriation still outstanding, and mass incidents happen from time to time. The land expropriation and removing has become an issue of great contention in the whole society, and one of the biggest controversies is the compensation and allocation standard of land expropriation. Choosing the compensation and allocation standard of land expropriation to conduct research, this paper through the provincial pilot experience summary of the reform for land expropriation compensation system, aims to analyze the existing problems in the land expropriation compensation legislation and current practice of our country, offer the proposal for optimizing the land expropriation compensation standard and cost allocation system in our country, and provide the reference for the reform and of legislation of land expropriation compensation.This paper includes five parts: The first part is introduction, including the selected topic background, research status and existing problems of research and the research significance, the purpose of the main content of research, research methods and research ideas; The second part is the basic theory part, including the concept and characteristics of land expropriation, basic principles, concepts and theoretical basis of land expropriation compensation, the principle of land expropriation compensation, etc. The third part is the history of the land expropriation compensation standard and the present situation of development, including the evolution process of land expropriation compensation standard, the present situation of land expropriation compensation standard, and the characteristics of the development of the compensation standard for land expropriation in China. The fourth part is the problem of land expropriation standard and compensation distribution, mainly including the principle of determination for land compensation standard, the measurement of land compensation standard, and the problems existing in the compensation cost allocation system. The fifth part is suggestions, including exploration of diversified compensation mode, reform of monetary compensation mode, reform of compensation standard calculation, reform of land expropriation compensation system and compensation for distribution system etc.
