Power Boundaries Between The Government And University Research

Government and university has a close relationship, both power boundary clear as to whether or not, is to straighten out the relationship between the two important factors, the boundaries of the clear power, is favorable for them to follow their respective scope of authority to act, a win-win development. The power boundary between government and universities in China with the development of society and change. In 1999, the higher education law "after the implementation, the power boundary between our government and university has been clear, but there are still blurred the boundary between the two issues, government power boundary consciousness weak, joined the law entrusts with the university autonomy, inhibit the enthusiasm of university development, hindering the process of the construction of modern university system and higher education system reform.Boundary has the properties of restriction and adjustment, the power of the government is bounded, how to draw a clear line between the power boundary between the government and the University; how to implement both the power of the boundary has been difficult problem that puzzles the development of higher education in our country, this paper based on the national conditions of our country under the background of, granted to the University by the "Higher Education Act" autonomy, the part is possession of government and the formation of cross power as the research object, to the development of universities to better to analyze problems and solve the problem of starting point, through the theory and research combining specific analysis of the existing problems, and puts forward two countermeasures of procedural and substantive. This paper is divided into five parts, trying to draw and implement the power boundary between the government and the University and promote the common development of the government and the University. Due to the limited space, this article studies the university only refers to the public university.The division of the power boundary between the government and the university is actually the problem of "high teaching method" to the two power allocation; the implementation process of the two boundaries is actually the process of the two games. The government of any country will in the internal affairs of the university management, but the degree of involvement of the different, only according to the balance conditions and the actual situation of the intervention, not to break the boundaries of power, in order to promote the development of higher education. The following is the main content of the article:First, in the part of introduction by absorption based on the relevant research results at home and abroad and according to the interview experience and the research content of study, the innovation of two aspects: in terms of topic selection to the new perspective of power boundary to study the relationship between government and University; in the content of the study put forward two countermeasures of procedural and substantive.Second, in the first chapter, concept analysis pointed out: power and right is refers to the government’s power, the university is on the internal power and external power; the power boundary between the government and the university is refers to the government "is their own power" and "only in the scope of the rights of University". The theoretical and practical basis for the boundary of division of power source is divided in university academic freedom; start source is divided in the reform of the institutions; more urgent division lies in the fact that the country attaches great importance to and power of the list of widely carried out should be.Third, in the second chapter the contents of government management of the University and the higher education law "Empowering University compared analysis both in principal selection, enrollment, professional settings, teaching management, assessment employed position power cross and intuitive presents the status of government and university power boundary is not clear.In the third chapter, the five chapter analyzes the concrete problems in the fourth aspects which are caused by the power boundary of the two. The fourth chapter analyzes the reasons of the unclear boundary between the two powers from the three aspects of the higher education law, the government and the University. The fifth chapter from the program proposed by law as a confirmation of the main body of the government and the University’s power boundary; substantive proposed five aspects of specific measures and government and universities to jointly safeguard boundary is proposed, in order to improve the boundary of the power government and university research.
