Research On Problems And Countermeasures In The Implementation Of The Government Information Disclosure System

While the role of the government information in public life is more and more prominent, the government information disclosure has becoming an institutional arrangement in democratic countries to meet the citizens’ right to know, with the information age arriving and the democratic participation of citizens’ consciousness awaking. As an important element of the national system of governance, the government information disclosure system includes the system construction and implementation in two aspects, which is an important embodiment of the modernization of national governance. The tortuous course of the government information openness system construction in the western democratic countries enlighten us the implementation of the government information disclosure system has self-evident meaning for building openly-transparent government, a rule of law government, and forced government reform in the context of the modernization of national governance, comparing to the system construction of the government information. So the government information disclosure system effective implementation has an unique practical necessity for national system of governance in four aspects including the governmental authority, the democratization of the governmental decision-making, the transparency of the governmental power-operating, citizen’s orderly political participation.The structure of this paper can be divided into four parts. Firstly, based on the existing administrative transparency report and the government information public annual report, we expound the present situation of the implementation of the implementation of government information disclosure system. Moreover, we not only summarize the achievements of the implementation of the government information disclosure system which consisted of active disclosure, disclosure upon application, supervision and remedy system and so on. And combining with theoretical analysis of causing the problem, we found the reason why the implementation of the government information disclosure system that the legal content is legislation defects and insufficient implementation capacity of the government information publicity system, which the former is part of objective factors, the latter is part of subjective factors. Finally, from the perspective of the implementation of government, we put forward the countermeasures to optimize the standardization level of the government information disclosure system, the execution mechanism of the information disclosure system, the quality and ability of government department in carrying out the system in three aspects. The conclusion that government information disclosure of government information is the trend of the times and a long road. Concerning about the disclosure of government information system implementation issue, we cannot left it unchecked and cannot be too much to look forward to solving it. We should improve the government information disclosure system construction in confidence and need change the mode of operation, which is determined to improve the executive power of the government information disclosure system. The way in resolving the implementation of the government information disclosure system is that enhancing the constitutional status of the right to know is the premise, improving the publicity system is the guarantee and transforming the idea is the key, decentralizing the government information control is essential.
