Research On The Improvement Of Rural Residential Homestead Withdrawal Mechanism In China

Homestead exit mechanism is a set of mechanisms to the core of the homestead exit behavior.It includes both the center of the exit mechanism for the homestead and the compensation and guarantee mechanism to ensure the smooth implementation of the homestead exit behavior.Its main function is to promote the smooth implementation of the homestead exit behavior,improve land use efficiency and promote the integration of urban and rural development.However,in China the property law,land management land and other relevant laws on the homestead exit mechanism is not perfect and also cause a series of problems such as the homestead property is fuzzy,homestead right is incomplete,lack a system of paid use for a deadline and there are some defects in the recovery condition of Homestead.Through analysis the homestead exit mechanism of the pilot areas,draw lessons from the pilot areas’ experience of success to improve the rural homestead exit mechanism in China.Reform property rights system of homestead,establish term system and paid system of using homestead,improve the conditions of recovering homestead,construct scientific homestead exit compensation mechanism, set up a perfect exiting guarantee system of homestead. Finally, to achieve the optimal allocation of land resources,to maximize the legitimate rights and interests of farmers,urban and rural development.
