Since the end of the last century, with the continuous progress of Chinese education law, various educational relationships are becoming more and more complicated and social legal consciousness strengthens day by day, the disputes in the field of education also showed a rapidly rising trend, which has seriously affected the stability and development of the education.Through the relevant investigation and analysis of all kinds of educational disputes reality, this paper attempts to use the relevant theory in order to make clear how to solve the educational disputes in the view of the Lowest-Demand Human Rights and how to solve a series of problems.This paper consists of 4 parts:The first part is the introduction. This part mainly discusses the research questions, research significance, research purpose, research content, literature review, research methods, research ideas and the research innovation points etc..The second chapter, the theory of the solution of educational disputes in the view of the Lowest-Demand Human Rights. This part mainly discusses the theoretical basis of the solution of educational disputes in the view of the Lowest-Demand Human Rights, which including the theory of human rights, the theory of harmony, and the theory of conflict.The third chapter, the plight and the reason analysis of the realization of the Lowest-Demand Human Rights in education dispute resolution. The main content of this part is to put forward and demonstrate the difficulties of the realization of the Lowest-Demand Human Rights in the education dispute resolution, that is, the realization predicament of the educational civil dispute resolution and the difficulties in the education administration dispute resolution. In addition, this part also focuses on the analysis of the two reasons for the plight of the Lowest-Demand Human Rights in education dispute resolution.The fourth chapter, the breakthrough path of educational dispute resolution. In view of the difficulties and the reason analysis of the realization of the Lowest-Demand Human Rights in education dispute resolution, this part put forward the breakthrough path and strategy from two aspects: the subjective and the objective. The subjective aspect of the breakthrough strategy mainly includes improving the power of the executive’s personal moral beliefs and improving the mind and ability of the people who have the Lowest-Demand Human Rights in education dispute resolution. And the objective aspect of the breakthrough strategy mainly includes strengthening the construction of educational laws and regulations, the sound education dispute resolution mechanism and the right relief system.
