Research Of Administrative Responsibility About University Entrance Examination Cheating

Nowadays, the university entrance exam cheating has been the fate for each examinee. In the college entrance examination, most of the students can observe discipline, cheaters were just a few, however, it is that a small group of cheating has already caused the wide attention of the society; in contrast, the administrative liability caused by the university entrance exam cheating has been rarely mentioned. Therefore, based on the university entrance exam cheating administrative responsibility as a breakthrough point, through the analysis of typical cases, from the liability subject, constitutional jurisprudence, contrast penalty similar cases at home and abroad and the present legislation defects to carry on the elaboration, and then from two aspects of entity and procedure detailed in this paper. At the entity level, according to the administrative responsibility subject of university entrance exam cheating as the main classification basis, I would mainly research the scope of the existing laws and regulations from the cheaters, the examination personnel, and other administrative organs in detail elaborated. For cheaters, from the current relevant provisions of the laws and regulations as well as to the current cases handled, the examinee of administrative responsibility mainly means for administrative penalty. For examination staff is mainly two handled solutions, administrative penalty and administrative sanction. For other personnel worked in administrative organs, mainly refers to the parents working in administrative organs, the punishment for such personnel are administrative sanction. At the application level, the main research is the administrative responsibility of following three stages, before exam, during exam and after exam.It is apparent that the existence of the university entrance exam cheating has seriously damaged the normal function of the current college entrance examination in China, and then I will give some legal advice about following three aspects, legislation, law enforcement, legal supervision on the administrative responsibility of the university entrance exam cheating. Strengthen legislation in the legislative level, let the formulation of the basic law of the people participate in the examination; Adopts the system of exchanging teachers’ examination sites in the law enforcement level, using the cross over the way to add cent conditions across regions is maintained; In the aspect of legal supervision to strengthen the sense of duty and the news media supervision in order to guarantee the university entrance exam system of justice.
