Research On Administrative Liability Of Legal Person

In current laws and regulations, the word “administrative liability” refers to the responsibility of the administrative subject and staff, also refers to the administrative relative person’s responsibility. This paper is a study of administrative liability of legal person with the administrative penalty counterpart perspective, which is based on the current law in the text of "the administrative liability" concept as a category. At present, in the field of administrative liability of legal person, there are many problem, such as legal provisions scattered, administrative enforcement difficulties, The indistinct object of administrative punishment, and so on. These problems are mainly from two characteristics of the administrative liability of legal person. One is various forms of legal person’s administrative liability, and the other one is the changing subject of legal person’s administrative liability. When I summarized legal person’s administrative liability, which scattered in various legal provisions, I discover that the real root of these problems is the administrative liability of legal person is lack of theoretical support and adhesive. So this paper establishes a theory of the ability of administrative liability of legal person to explain these problems above and to integrate the legal person’s administrative liability. Through the above method, a complete system of legal person’s administrative liability which includes corporate independent liability, corporate and its representative several liability, corporate and its representative independent liability and liability of legal person in special circumstances is set up. In research methods, this paper, with the guidance of the spirit of positivism, mainly uses the method of empirical analysis. This paper also uses the methods of Sociology and comparative analysis as a supplementary method. Hope that the research of the administrative responsibility of future benefit.The paper divides into five parts altogether. The first part of the article has introduce the purpose of this research, research status and the basic concept. The second part of this paper has introduce the characteristics of the administrative liability of legal person. The third part of this paper has constructed a theory of the ability of administrative liability of legal person. The fourth part of this paper has integrated the legal person’s administrative liability and has made them become a system. The fifth part of this paper is epilogue. I wish this paper can call the administrative law circles paying attention to the study of administrative responsibilities of administrative counterpart.
