With the development of social productive forces, the rapidly progress of scientific and technological and the adjustment of the industrial policy, agriculture-based traditional rural society is gradually in transition to urbanization. However, urbanization land shortage has become one of the constraints of the current economic development bottleneck, especially in current condition that the collective construction land market should be contained be the whole market with the value of rural land of construction is be emphasized more importance. From the establishment of People’s Republic of China, the degree of the allocation of land resources is very low. The policy of land contract management rights was first proposed in 1984, the work, the transfer of rural construction land, has been in tested in Wuhu, Anhui, Guangdong Nanhai in the late 1990s. So far, the collective construction land transfer market has been widely expanded in many parts of China, but there exists some problems to solve. Owing to the legal restrictions and regulations, the mode of collective construction land market circulation is in confusion, the order of institutional arrangements is out-of-order and lacking of effective supervision, the stealth circulation of rural land is widely spread, and the problem of "small property room" is more frequently. In all, to achieve the high economic value of collective construction land, the proper situation of administrative turnover, the design of the public system of recognition of rural collective construction land is in urgent need.A new mode of collective land, the rural collective construction land that is equivalent to the implementation of the state-owned land in market is permitted to transfer, lease and share in line with the planning and control purposes, was adopted. But it should be noted that China’s current laws and regulations and policy documents not the concept of collective operational construction land and the method of the distribution of the stock market and income is in blank in China’s law and regulations. From the practical perspective, the system, the income destruction of collective construction land market, has been set in many places, but there exits some problems, such as the confusion of the regulations about the income distribution, the shortage of regulations about income formation and distribution. Therefore, we should improve the current laws and regulations and deepen the reform of the collective operational construction land market to make the construction and innovation of the income distribution of rural collective construction land market perfectly.In order to solve the problem of the collective construction land market operating income distribution, three steps should be taken. In the first, a high degree of market participation mechanism of the collective operational construction land market should be adopted. Secondly, a reasonable income distribution system should be satisfied for the regulation of law and the function of the government, so some specific system, such as the minimum price system and land tax system, should be perfected. At last, we should strengthen the guarantee of the land-use system, and establish a reasonable rural collective construction land market income distribution system which reaches the balance between the national and legitimate, collective and individual.
