Research On The Legal System For Distributing Thevalue-added Benefits Of The Collective Operational Constructive Land’s Circulation

The reform of Chinese economic system has entered the "Deep zone.” the drawbacks of the existing land system gradually be exposed. The current realistic problem to be solved of our country’s deepening land’s reform is to establish and improve income distribution mechanism, fully protect farmers’ land rights, realize the equitable distribution of land value-added benefits for state,collective and individual. With the Third Plenary Session of Eighteenth Central Committee confirming “collective operational constructive land’s circulation” on the level of policy,it seems necessary to study the legal system for distributing the value-added benefits of collective operational constructive land’s circulation.The improvement of legal system for distributing the value-added benefits of collective operational constructive land’s circulation is beneficial to the use of country’s land, the improvement of farmers’ income and the development of farming economy. Afterwards, the paper analyzes the worth pursuing, basic principle of the legal system and proposes the current situation and problems of our country. Finally, combining the practices of China, the paper puts forward the specific suggestions from five aspects. Four main parts are included except the introduction and the conclusion in this paper.The first part expatiates the general theory of the distributing the value-added benefits of collective operational constructive land’s circulation. This part includes three articles. Firstly, a few involved key concepts are elaborated. Secondly,from the point of theory, this paper expounds theory basis of the distributing the value-added benefits of collective operational constructive land’s circulation, from the aspect of lands’ ownership, rural development rights and villagers’ autonomy. Finally, the paper analyzes the contents of the distribution.The second part is about the value target and basic principle of the legal system for distributing the value-added benefits of collective operational constructive land’s circulation. First, this part elaborates the value target of the legal system for distributing the value-added benefits of collective operational constructive land’s transformation, from economic, substantive fairness and social harmony. Then, elaborating that the improvement of legal system for distributing the value-added benefits of collective operational constructive land’s transformation should follow the principles of economic efficiency, optimize the allocation of resources and the principle of sustainable development.The third part is status and problems of the legal system for distributing the value-added benefits of collective operational constructive land’s circulation. This part introduce it from legal basis, price system, tax policy, and regulatory measures. The main purpose is to master the legal system’s reality deeply,and establish the foundation to perfect the following legal system.The forth part is the specific countermeasure to improve the legal system for distributing the value-added benefits of collective operational constructive land’s circulation. This part is the emphasis and destination for the paper. Aiming at the urgent problems,the paper put forward some suggestions to improve the legal system for distributing the value-added benefits of collective operational constructive land’s circulation,from the perspective of legal basis,legal system of price,legal system of tax and legal system of supervision.
