Research On The Risks And Countermeasures Of Maritime Administrative Law Enforcement Based On Ship Management

With the rapid development of the process of governing the country according to law, Maritime Administration is keeping strengthen the legal consciousness relative to people, The public and the consensus supervision is strengthened day by day, remedies including administrative reconsideration and administrative proceedings are more perfect. While the internal accountability and accountability system of Maritime sector are gradually established and improved,the number of cases which The maritime sector and its law enforcement personnel being investigated due to their Subjective,objective, technological or moral problems leading to malfeasance is increasing rapidly. Therefore, studying the law enforcement risks in the process of fulfilling the duties of ship management, analysis the reasons for its causes. In-depth, and taking corresponding preventive measures can improve the efficiency of accuracy of law enforcement and law enforcement. It plays an important role in improving the efficiency of maritime management, constructing service-oriented maritime, and establishing a good external image of the maritime.In this article, the concept of ship management and the maritime administrative law enforcement were defined, and analyzed including the forms of maritime administrative law enforcement risk, the links risks appear and the characteristics of risk. In this article, author analyzed the reason why the maritime administrative law enforcement risk caused, then eight reasons were proposed. The eight reasons include that laws and regulations system being imperfect, the responsibility boundary being unclear enough, the objectives and tasks set being not scientific enough, the supervision of information construction lagged behind, the external environment being complex and severe, and the emergency response mechanism being imperfect, and so on. At last, it was given eight targeted proposals which include strengthening the construction of the law and regulation system of ship management and the administration of ship management by law, enhancing the construction of the team of maritime law enforcement team and law enforcement information, strengthening the construction of internal control mechanism, to create a civilized and impartial law enforcement environment and improving the mechanism of emergency response.
