Against Unfair Competition Law has contributed a lot since its enforcement on repressing unfair competition acts, safeguarding the stability of market economy and protecting the lawful rights and interests of consumers. Just like that things move on,science and technology develop constantly as well which has brought a big improvement on convenience and comfort of people’s life. One outstanding pact is the emerge of the Internet. The Internet begins to go to thousands of families thanks to the quick development of science and technology. As more and more people are accustomed of shopping online, online market has formed gradually. And online economy becomes an important part of market economy. With the same fierce competition, the difference between online market and traditional market is that online business operators take competition means with high-tech content. Of course, one of those are acts of unfair competition in order to gain profits. It’s very difficult to regulate online acts of unfair competition in practice because it is new and has high-tech content. These acts are of high-tech content and converted. Moreover, since there are no such explicit provisions on these acts, the law executors are facing lawlessness. Online acts of unfair competition low down the base line of business moral again and again that cause more deep and wide harm than those of traditional market. The market raises the question that how to deal with online unfair competition and punish online acts of unfair competition. We could make more targeted and feasible measures if analyzing their types, origins and harm.There are seven chapters in this article. Chapter One introduces researching background, significance, the academic summary and the train of thought as well as the researching methods of this article. Online acts of unfair competition occur frequently nowadays when the Internet influences people’s life profoundly, so that it’s significant in both theory and practice to study those acts intensively. Chapter Two illustrates the features of online market, types of online acts of unfair competition and the features of online acts of unfair competition that distinguish them from other acts of unfair competition. Chapter Three introduces how our country regulates online acts of unfair competition and also what we could improve in legislation, jurisdiction and enforcement. Chapter Four summarizesthe experience of America, Japan and Germany on online acts of unfair competition in that there are a lot worthy for us to learn, such as German regulations endowing consumers rights of group action. Chapter Five illustrates the author’s thoughts about how to identify online acts of unfair competition from subject, object and so on. Chapter Six brings out the author’s opinions. At the last chapter, the author holds great hope to expect new regulations on online acts of unfair competition in fixed laws.
