With the maturity of Internet technology,the scale of Internet users is becoming larger and larger.More and more traditional enterprises use Internet technology to promote the combination of the advantages of traditional industry operation modes and the Internet,and explore and construct a brand-new business operation model.Tourism companies are no exception,and tourism companies with Internet platforms have added new impetus,and online travel enterprises have emerged.The technology of foreign online travel enterprises is becoming more and more perfect,and the business model has been relatively perfect.However,the domestic online travel enterprises are still in the initial stage,and the business operation modes are diverse.The tourism products and services are different,which belongs to the rapid growth period.At present,the tourism product service in the domestic tourism OTA market is more diversified,and the consumer groups are more refined to better meet the individual needs of users.Online travel enterprises are diversified.The main business operations can be divided into four categories: business tourism comprehensive search enterprises,vertical search price enterprises,tourism social enterprises and tourism service platform enterprises.However,online travel enterprises are highly homogenized.Some large-scale enterprises use price wars to crowd out competitors,and some enterprises use high-end network technology to damage the interests of other operators,resulting in frequent unfair competition in the tourism OTA industry.However,there are fewer laws related to unfair competition in China's OTA enterprises,and the punishment is relatively low,which increases the illegal probability of online travel enterprises.At present,the research of online travel enterprises mainly focuses on the basic theories,business models,marketing models and legal regulations of online travel enterprises,while the research on Internet unfair competition mainly focuses on the conceptual methods and the "Anti-Unfair Competition Law".Investigate,few scholars have conducted research on the unfair competition behavior of online travel enterprises,and there is very little research on the legal regulation of related aspects.However,with the outbreak of unfair competition in the tourism OTA market,it is urgent to fill in the gaps in related fields and provide practical methods for the regulation and revision of the laws governing unfair competition in online travel enterprises.Therefore,this paper discusses the legal regulation of unfair competition behaviors in online travel enterprises,and uses the content analysis method to sort out and summarize the relevant literatures,and summarizes the factors that affect the unfair competition behavior of online travel enterprises and design questionnaires,with the help of SPSS 20.0 software.The data of the questionnaire were analyzed to determine the main influencing factors.Through the evolutionary game theory,the author analyzes the strategic choices of online travel enterprises and regulators,constructs the evolutionary game model of online travel enterprises and regulators,uses MATLAB 7.0 software to carry out numerical simulation,explores the evolution trend,and based on the research results,provides theoretical support relevant laws for the improvement and introduction of relevant laws in China.
