Children are the future of the nation and the hope of the motherland, representing the development potential of a country’s human resources. Healthy growth of children related to the stability of the state and society, but also the focus of attention of millions of families. However, frequent accidents happened in the children food market in China, andchildren food safety issue has caused the national attention and debate in recent years. In 2015, our country enacted by revising the Food Safety Law. But in the new law, the content of children food safety is very few. In the real set of legal supervision system, regulation aimed at children food safety is not perfect. It is necessary for us to construct and perfect it in the field of children food safety supervisionThus, the article focuses on some practical problems of childrenfood safety laws and regulations and makes view of the specific case in reality.Mainly divides into the following several aspects:The first part mainly lists two real classic case, and analyses and summarizes a series of problems in Chinese childrenfood regulatory domain. It mainly involves: At the legislative level, there is no specific definition of concept of children food, and no specific safety standards of children food in our country; In specific areas of regulation, the regulatory agency of children food safety is not clear, and relevant regulation is not in place; and children food safety legal responsibility mechanism is not perfect.The second part carries out a series of studies on many problems in the children food market. Firstly, clearly defines the children and children food, which does for the children to eat and can satisfy the physiological need of all kinds of food, in the law. Because the children has the characteristic such as indecisive, learning, childrenfood shall ensure the safety and nutritional health in the process of production. According to the characteristics of children food itself and the difference of its function, we divides the children food into seven categories such as staple food for infants, infants consisting and so on.The third part on the premise of clear defining the connotation of the children food, carries out study on children food safety standards. In the process of research, the text refers to other countries in the aspect of children food safety standards of laws and regulations, and carries on the induction summary and provides a concrete proposal in the standards for packaging and labeling, food additives and children advertise foods.The fourth part clarifies the responsibilities of children food regulatory agencies, establishes the regulatory system, with government regulation as the core, school regulation as the priority, social regulation as the guarantee. Establish and improve the children of the HACCP food safety guarantee system and the entire regulatory system, so as to complete the systematized creation of children food safety regulatory agencies.The fifth part increases punishment for somebody who violated children food safety laws and regulations. It clarifies the responsibilities of the relevant regulatory body and builds the responsibility of children food security assistance system including compulsory liability insurance and social assistance funds. Based on further improving the legal regulation system of children food safety, to ensure children food health security and make children more healthy and happy growth.
