Along with the continuous development of our society, our country’s law is constantly improving, and the realization of citizen’s right has been protected. The development of both countries and individuals depends on education, which limits the development of the state and the individual. As the country’s hope and future, education is the most important for them. Aristotle once said that every state of the legislature should care about what is the education of young people. The city that does not pay attention to this point is often suffered a huge loss. The overall education level of our country and the education level of the developed country still exist a big gap, there are many aspects that need to study and improve continuously, and the education of the countryside is the lowest level in the whole education of our country. As the most weak economic development of our country, the rural areas are affected by the education situation. In recent years, the right to education in rural areas has become the focus of discussion. As a part of our country education, the realization degree of the Rural Minors is influenced by the degree of the whole education. It is necessary to improve the education of our country. So it is very important to protect the rights of Rural Minors.There are still many problems in the course of the realization of the education right in rural areas in China. There is a big gap between the rural education and the Urban Minors, which affect the whole level of our country. From the state, society, schools, families to Rural Minors themselves, not only from the different aspects of the education of minors in rural areas, but also to different extent, violations of the legitimate rights and interests of rural minors. Therefore, the realization of the right to education in rural areas is to start from the social, school, family and Rural Minors themselves, so that the right to education in rural areas is not the real realization of the right to education.There are defects in the legislation on the right to education in rural araes, the international human rights law plays an important role in the protection of minors, and it is the standard of various countries. However, in the process of formulating and implementing, the formulation and implementation of the main body are not fully understood. The education right of the Rural Minors is not perfect, some problems can not be solved effectively through the legal way. Secondly, in rural areas, the supervision system is not conducive to the realization of the education right of Rural Minors, and we should improve the supervision system of minors. Once again the guardians of Rural Minors and the Rural Minors themselves to the right to education, the legal consciousness of the right to education, the main body of the right to education can not be achieved in the ideological basis. At last, the most important problem of the education right in rural areas is reflected in the uneven distribution of social resources in the region. Thus it can be seen that the promotion of the education of Rural Minors in the deeper level of the realization of the need for a long time.This article mainly carries on the research to our country countryside minor education right, through the use of literature research, comparative analysis and data analysis, analyzes the generation and development of education, the concept and basic characteristics of education, and then rises to the right of education.This paper mainly includes five parts: the first part is the research background, research significance, domestic and foreign research status, research methods, structure and innovation points of this problem. The second part is mainly about the right to education, including the emergence, development, concept, basic characteristics and the legal analysis of this basic right. In the third part, we put forward the problems of the education right in rural areas of our country at the present stage, mainly from the aspects of legislation, supervision system, legal consciousness and the distribution of social resources. The fourth part is mainly for the third part of the main issues raised by the corresponding improvement, proposed specific measures to protect the Rural Minors education.
