Research On System Of Environmental Verification For Quoted Companies

Environment is closely related to people’s production and living life. China has been developing rapidly in economy while environmental issues and destroy of environment problem become increasingly serious which directly threatens the development of modern society since the era of industrial civilization. China government puts so much attention on pollution prevention measures, thus making it clear that protecting the environment is China’s basic national policy. It is said that environmental protection is still the main control measures in China, and the aspect of industrial pollution preventions becoms the primary task. Environmental verification of quoted companies is a preventive measure which could not only avoid the market risks existing the unreasonable collective-funds put, thus protecting investors’interests, but also avoid the serious environmental pollution and destruction caused by hysteresis of the environmental protection. Currently, in its infancy, there are many problems like lack of clarity in obligation on environmental protection of the companies in this institution, and basic environmental infrastructure is lagging, Listed Company profit-driven approach is more likely to achieve pollution and damage to the environment to maximize their own interests. Moreover, academic verification regime for listed companies has little environmental studies. Therefore, it is important to study this institution in our country.Full Text addition to the introduction into the following three parts:The initial part interprets the listed company’s basic theory of environmental verification regime with the beginning of the concept and features. Environmental verification regime of listed companies is a supervision system which contains the administrative department of environmental protection and the issue of shares listed on the first applications for refinancing, restructuring or asset to be taken from other forms of capital market financing enterprise environmental management, environmental protection and law-abiding conduct comprehensive verification, ongoing disclosure of environmental information, follow-up supervision. The system has comprehensive features regarding the demanding, on-site inspection, information disclosure, social supervision, green financing, and many others. Secondly, the test discusses the development three relatively distinct phases of the verification regime of environmental protection of listed companies which are the formation stage, standardization and improvement phases. Finally the paragraph elaborates the value and function. This will help standardize the environmental behavior of enterprises; help to avoid investment risk due to environmental problems caused; help to promote healthy and long-term business development; conducive to building a harmonious society; help improve people’s production and living environment to ensure sustainable social development.The second part analyses the listed companies’ main environmental problems of the verification regime in China, which performs in the legislative level, the level of law enforcement and legal remedies which also regarded of judicial level. At the legislative level the main problems are:the errors concept of the existing legislation; institutional measures appear blanking. At the law enforcement level the main problems are:the loopholes of the content of law enforcement; lack of administrative enforcement measures; rigid accountability mechanisms, such as law enforcement. Problems in the judicial level mainly reflect:the useless of administrative relief channels, and judicial relief mechanism is blank.The third part of the test focuses on the improvement of China’s listed companies to environmental verification regime, which involves many aspects. For the major environmental problems exist in terms of the verification system, the improvement should be highlights on the following aspects:to reconstruct of the concept of environmental protection legislation verification regime; to improve of relevant legislation and supporting measures; to clarify the deification of environmental enforcement contents; to innovate environmental enforcement methods; to establish accountability system; to list disclosure system of verification; to sound administrative reconsideration system; to perfect corporate environmental verification judicial relief system.
