The Improvement Of Legal System Of Protecting Ecological Interests In Island Of Our Country

Ecological protection has been stimulated on the part of the aim of legislation in "island protection law", which fills our blank on the legal system of protecting ecological interests in island in legislation to some extent. However, disorderly and excessive exploitation damage the ecology of island seriously, which has caused some problems in the practice of ecological protection. Thus, the legal system of protecting ecological interests in the area of island still needed to be consummated.Nowadays, the contradiction between exploitation and protection is aggravating. The destruction of island ecology directly harms the interests ofhuman beings. So, human ecological interests needs to be emphasized and protected so adequately that guarantee conversely the achievement of economical interests and political interests. The phenomenon of danger damage the ecology environment of island cannot be eradicated for four reasons that is not adhering to the center of obligation, ambiguous legislative purpose, the fundamental principals lacking of pertinence and not construct the system under the conducting of duty as center. Firstly, the paper bases on the current situation of island source and exploitation in our country; secondly, analyze the problems of legal system of protecting ecological interests from theoretical perspective and foreign legislative experience; finally, draws the conclusion that the center of obligation must be adhere to, declare protecting ecological interests as the supreme legislation purpose, prior to ecological environmental protection principle and public participation principle in island, and constructs concrete institution containing three aspects of island users, administration and the public.
