Research On The Institution Of The Ecological Protection Of The Southern China Sea Island

The ecological protection of the South China Sea Islands is of great concern in the international community.Western countries are doubtful about the applicability of the current legal system on the protection of the South China Sea Islands.At present,the island environmental protection legal system,which is the main body of the island protection law,lacks special ecological environment for the South China Sea Island.The protection system of the environmental protection law and the law on the protection of the marine environment on the protection of the South China Sea Islands is too principled and concrete.It is necessary to think and discuss this problem in theory,and a set of system for protecting the ecological protection of the South China Sea Islands is needed.In view of this,this article launches the discussion on the ecological protection system of the South China Sea Islands.This article is divided into four parts:The first part discusses the particularity of the South China Sea Islands and its ecological protection.The two particularity of the location and ecosystem of the South China Sea Islands and reefs are discussed.The remote and near equatorial geographical location of the South China Sea reefs has created a special ecological environment.The relatively closed reef ecosystem leads to the special treatment of the South China Sea reefs in the process of ecological environment protection.The second part is the analysis of the current situation and problems of the ecological protection system of the South China Sea Islands.From the two aspects of national legislation and local legislation of two provinces in Hainan and Guangdong,the present situation of China's South China Sea island protection system is described.Too many legislative principles of the state lead to the lack of direct applicable laws and regulations in the process of protecting the ecological environment in the South China Sea Islands.Hainan province is a major province of the South China Sea Islands.At this stage,the progress of local legislation is slow.Guangdong Province,as a more advanced province in China,has opened a good beginning for the protection of the ecological environment of the South China Sea Island by the establishment of the island protection regulations of Guangdong province.On the basis of the protection of the ecological environment of the South China Sea Island,the backward legislation has led to a series of problems,such as the unsound prevention and control of the waste pollution in the ecological protection of the SouthChina Sea Island at the present stage,the unidentified division of labor of the island supervision system and the obstruction of the law enforcement.Moreover,the South China Sea Islands are not classified according to the different properties of islands.The third part is to compare the ecological protection system of foreign islands and its reference to the ecological protection system of the South China Sea Islands.Some foreign countries have the "ecological supervision and management system" of South Korean island,the American island "ecological protection classification protection system",and the island "separate legislative protection system" in Australia can provide a good reference for the sound supervision system,the management of classified protection and the timely and effective implementation of the South China Sea Island legislation.The fourth part is the author's suggestion on the ecological protection system of the South China Sea Islands.First of all,we should adhere to the principle of China's priority of ecological protection of the South China Sea Island,prohibit the exploitation of natural resources on the South China Sea islands in principle,and strengthen protection for some tourist resources available for development.Secondly,we should promote waste sorting and recycling,popularize new technologies,and clarify the obligations of all parties in the garbage collection process.In the process of law enforcement of the ecological protection of the South China Sea Island,the mechanism of multi department joint law enforcement should be promoted,To share the information of the main body of the islands,and to carry out the law enforcement action in time and effectively.Then,according to their respective particularity,the South China Sea Islands and are classified and classified according to their respective characteristics.Finally,we should strengthen the legal responsibility of all parties in the process of ecological protection of the South China Sea Island as the final barrier of the ecological protection of the South China Sea,increase the punishment of the violators,and make clear the legal responsibility of the main bodies of the islands and to urge the parties to work each other in the process of the ecological protection of the South China Sea islands.
