Research On The Reform Of People’s Jury System In The Perspective Of Judicial Justice

The people’s jury system is our country citizen participation in trial activities the most basic form, the system in the development of judicial democracy, to promote judicial justice and improving the public credibility of the judiciary has very important influence.In the current reform of the judicial system, people’s jury system in the promotion of democracy and justice and promoting judicial justice has very important influence. On October 28, 2014, the Fourth Plenary Session approved "the CPC Central Committee decided to advance the rule of law on major issues"(hereinafter referred to as the “decision”). The "decision" stressed the improvement of people’s jury system in getting people involved in justice to protect the jury rights of citizens,expansion the scope of jurors and random standard on selection of jurors to improve public confidence in the people’s jury system. In recent years, according to the people’s jury system in practice the problems, combined with the “decision” proposed reform, this article mainly from the “doubling plan”, the selection mechanism and trial mechanism of these three aspects of the specific reform measures were analyzed,combined with the relevant research group proposed for the survey and empirical data dialysis, the reform measures is how to influence judicial justice, judicial justice to stand in the point of view to re-examine our people’s jury system, in order toreconstruct the people’s jury system to play its due role.The full text is divided into five parts: the first part(Introduction) is mainly introduces the background and the corresponding problems; the second part on the concept of people’s jury system and judicial justice, and introduce the people’s jury system and to promote the people’s jury system of justice for the realization of a series of reforms to do justice; the third part describes the implementation of the“doubling plan” discusses the realization of its justice generated, analysis the possible new problems, and put forward the feasible suggestion; the fourth part from the people’s jury system selection mechanism to discuss the reform program in the positive role of justice, to discuss the implementation of these new procedures whether the reform measures to achieve judicial justice; the fifth part from the people’s jury system, assessor mechanism research on the function of judicial justice,put forward the suggestions of reform measures and problems.
