According to the property law, the provisions of article 16 and article 17 a unified registration system over realties shall be practiced by the state, in the registration system, the real property register has a special position, which is the ownership and contents of the real property register according to, is real record, on the right ownership of property owned or transaction confirmation, have indisputable authority, in the real property register shows that real estate on the ownership and contents have the final effect, besides there is evidence to prove that real estate register is wrong, real estate property rights trading thereto to the real property register records shall prevail. Generally speaking, the real estate registration of real right is in line with the actual real estate property rights, but can not be denied the existence of the situation of the discrepancy. When there is a case the holder recorded in the book are inconsistent with the holder of the real situation, according to article 19 of the property law and the provisions of article 33 of the interested party may apply for correction of the registration, apply for dissidence registration or approval by litigation. This paper USES literature research, comparison research method, empirical analysis and other methods, due to various reasons lead to the content of the registration of practice are inconsistent with the actual rights type and how the wrong registration of real right holder.
