Basic Issues Of Legal Capacity Building Of The Communist Party Of China

Political party capacity issues are important relating to its survival and development. The quality of political party capacity has a direct impact on the smooth realization of the rights of political party. For Marxist party, because of its special historical mission, party capacity building is particularly important and critical, constituting the basis project of its own construction. As a Marxist ruling party, Communist Party of China has always been paying special attention to its own building since its foundation, continuing to explore ways to strengthen self-construction in practice, and enriching party building theory system. In 1949, Communist Party of China transformed into ruling party from revolutionary party, and began to explore effective ways of managing state affairs, eventually established the basic strategy of law-based governance of the country. The scientific level of both managing state affairs and its own building has been improved in practice.Standing at a new historical starting point, from overall view of maintaining and developing socialism with Chinese characteristics, Chinese communists profoundly grasp the practice demands for the rule-of-law in "party politics" and "globalization" era, with high degree of legal consciousness and theory self-confidence, make a comprehensive strategic plan to promote law-based governance of the country, and propose the grand goal of "building a rule of law China". This is an opportunity to build and develop rule-of-law in China, but also put forward new requirements and reality tests on the ability of the ruling Communist Party of China. This new capability requirement, in short, is whether the Communist Party of China has the appropriate legal capacity to lead the construction of rule of law in China. Clearly, legal capacity as an important dimension must add to the comprehensive ability of the ruling party, and legal capacity building become a major topic of the times in front of the whole party. In this background and based on the theoretical thinking of strengthening capacity support to the Communist Party of China, the paper conduct a preliminary and overall study on basic issues of the Communist Party of China legal capacity building under the new situation, in order to arouse interest and attention. It should be pointed out that the Communist Party of China Legal Capacity-building is an innovative proposition, this paper just explore into basic issues related generally.
