The Research On The Validity Of Schmidt Emergency Decision-making

Carl Schmitt’s thought is a hot issue in today’s political philosophy.Discussion about schmidt’s article is countless in the academic circles.We can’t help to ask,as a political philosopher having an affair with Nazi, why can he have such great influence in today’s academic circles? It’s because his determination of thought and the theory of state has very profound significance to the essence of the political.There are divergent views on the legitimacy of his thoughts.His idea was seen as the enemy of freedom and the rule of law country. Some scholars even think that his state theory will inevitably lead to the comeback of tyrant politics. However, the author believes that the legitimacy of his thought is questionable, and it remains to be further discussed.Taking the perspective of political philosophy,this paper’theme is political values of the emergency decision.And recommend Schmitt thought origin and Western scholars’ attitude. We are trying to explain his determination thoughts,learing it’s unique and advanced.And explaining its decision thought reasonable and unreasonable place through the understanding of the western academic circle.Finally we discuss whether the emergency decision-making theory is legitimate in contemporary political practice.The research of this paper is based on “whether his ideology determination were legitimate” as the main line.The first chapter is the introduction part, mainly introduced the selected topic significance and research status at home and abroad;The second chapter the uniqueness of his ideology determination as well as the formation of his ideology determination process with the inspiration of the other philosophers’ thoughts; The third chapter introduces two political philosophers’ attitude toward Schmidt’s ideology determination. Strauss and schmidt have a fierce debate on liberal modernity problem. Eventually Strauss defines schmidt’determination thought as a special liberalism. Habermas responses to his ideology decisions in Legal norms and public areas. In the fourth chapter we discuss schmidt determination’s legitimacy under the background of the contemporary erafrom three aspects,which is the rationality of criticism on liberalism,the necessary of judgement about enemy or friend,the legality of analyzing the state of emergency.
