Debt is the meta rule of social interaction and evolution, and the arrangement of the debt in different social structures determines the logic of social operation.In this paper, we try to deduce some moral conclusion about the law and the economy from the comparative view by examining the different debt logic between the gift economy and the commodity economy. The thesis is divided into four chapters.The first chapter explains the research background, research methods and the current situation of domestic and foreign research about the topic.The second chapter analyzes the gift economy and its legal symbols, and points out its social structure in the form of currency, social ties and contract, reciprocity and honor rules.The gift economy is the main reference system of comparative study, as well as the main social structure of Tibetan debt feast.The third chapter according to the legal ethnography investigation of Tibetan debt feast, empirically analyzes the form of legal bankruptcy under the society of gift economic.As a legal mechanism to resolve the debt crisis in the nomadic society,Tibetan debt feast shows ecological debt ethics by the legal function.But, with the expansion of the commodity economy today, it is gradually alienated.The last chapter based on the concept of personal bankruptcy and modern value that implicated in the Tibetan debt feast to deduced the moral inspiration for the perfection of bankruptcy legal system and deal with the debt crisis of capitalism liabilities.This article believes that only by returning to the solid legal tradition, can we avoid the alienation of capitalism.In conclusion,the growth of the gift economy will be the innovation spirit to the transformation of the commodity economy.
