China is a unified multi-ethnic country which has a wide variety of ethnic culture and heritage. However, with the economic development and the advance of urbanization, social and natural environment in which the intangible cultural heritage is also changed, which are to some extent affected the inheritance and development of intangible cultural heritage, especially in some precious intangible cultural heritage resources already at the brink of extinction. How to protect the country’s rich intangible cultural heritage resources, to maintain the diversity of intangible cultural heritage resources, it becomes the current problems to be solved. Although the legislation on the protection of intangible cultural heritage provides a legal basis, but in reality there are still a lot of intangible cultural heritage unsustainable, endangered, legal protection of intangible cultural heritage does not seem satisfactory.From a legal perspective, the content of Intangible Cultural Heritage Law is not capable of safeguarding intangible cultural heritage play a full, full and effective role. From a practical perspective, the practice of the legal protection of intangible cultural heritage not only need to rely on local laws and regulations as a supplement, and the appropriate authorities at all levels need to combine in practice, national and local legislation for proper implementation of the intangible cultural heritage reasonable Conservation and planning. Unfortunately, however, national legislation and local legislation in reality still can not do a good convergence, let alone place for reasonable protection of intangible cultural heritage with proper planning.This paper aims to sort out the status quo of the intangible cultural heritage legislation, analysis of the main measures of protection of intangible cultural heritage embodied in legislation, summarized in Yunnan Province intangible cultural heritage protection law practice experience, reflection Intangible Cultural Heritage Laws protection legislation and the main problems exist in practice, to explore a combination of the law and practice of the overall protection of intangible cultural heritage of regional roads, regional overall protection through the development model of the intangible cultural heritage on the basis of existing legislation more effective legal protection, and cumulative data for the further study of the legal protection of intangible cultural heritage field.
