The Study On The Supreme People’s Court’s Circuit Court

The Supreme People’s Court’s Circuit Court,on behalf of the Supreme People’s Court, is the resident agency sent by the Supreme People’s Court to the local,which is part of the Supreme People’s Court.Judgments, rulings and decisions made by it have the same effect with that of the Supreme People’s Court.At present, China set up two Circuit Courts, the first one covers Guang Dong, Guang Xi and Hai Nan provinces, while the second one covers Liao Ning, Ji Lin and Hei Longjiang provinces.It is an important decision made by the Communist Party of China to comprehensively promote to govern the country by law and to deepen judicial reform.It can play a role as a bridge between the Supreme People’s Court and courts at all levels in the circuit district,which is an important step towards judicial reform.With five thousand years history, the judicial system in our country now has the brand of the judicial system in the past. In different times and regimes, circuit trial has different connotations, but they have a common origin and have something in common. The anti-Japanese democratic regime’s circuit trial can be said to carry forward the mode and it fully reflects the advantage and era significance at that time.Moreover, Shan Xi-Gan Su-Ning Xia Border Region creats Ma Xiwu’s Trial Way in judicial practice which is called a model.In the era of war, circuit trial is a bright flag in the judicial work and plays a very good social role. So studying the Supreme People’s Court’s Circuit Court can be compared with the anti-Japanese democratic regime’s circuit trial to take the essence and discard the dross,and then perfect the construction of the Supreme People’s Court’s Circuit Court.The text is divided into six parts,the first part introduces the value analysis and the operating mechanism of the Supreme People’s Court’s Circuit Court in order to clear its rules in practice;the second part respectively expounds the implementation situation of the first Circuit Court and the second Circuit Court to learn their actual effect of operation and the necessity to set up the Circuit Court through analyzing the changes of judicial trial in the circuit area to;in view of the fact that it is a new thing, has just started, the third part analyzes the challenges encountered by the Supreme People’s Court’s Circuit Court from lacking of experience,local protectionism and judicial resources in short supply;the fourth part compares the Supreme people’s Court’s Circuit Court with the anti-Japanese democratic regime’s circuit trial and analyzes the limitations of the times of the latter one,and then obtains the enlightenments to the current practice;the fifth part puts forward the proposals of perfecting the Supreme people’s Court’s Circuit Court on the basis of the above discussions.
