Study Of The Dispute Resolution Mechanism On Current China’s Civil Flight Delay

Civil flight delay is a major problem faced by the civil aviation of both China and the world. Especially in recent years the number of China’s flight delay increases sharply. The delay leads to a surprising number of disputes, which have an negative effect on social order and social relations. Therefore, during the critical period of social change, we have to pay attention to the resolution of the civil flight delay dispute. By analyzing the main features and resolution mechanism of China flight delay dispute and combining the existing legal norms, this paper puts forward some points of the consultation of the dispute resolution mechanism.Firstly, according to defining the flight delay and analyzing the main features, the writer considers that dispute has increased dramatically; specificity and the massiveness of the dispute; unequal status of dispute subjects and prevailing of the dispute compensation rules; consequences of the dispute easily deteriorating. Through the grasp of the features of flight delay dispute, a prerequisite for the following study is provided. Secondly, analyzing of dispute resolution mechanism on current China’s civil flight delay, this paper points out that dispute subjects breaking faith and being out-of-balance in reconciliation resolution mechanism; imperfect administrative consultation mechanism and lack of professional ADR consultation mechanism in consultation mechanism; litigation resolution mechanism being out of elbows. Finally, this paper probes the rational consideration of dispute resolution mechanism on China’s civil flight delay. It mainly discusses the perfection of resolution mechanism, from disclosure of flight delay information, the credit regulation, building the people’s mediation committee of civil flight delay dispute and introducing test case.
