An Empirical Analysis Of Criminal Victims Judicial Relief In Yanbian

Recent years, criminal victims study research has been developed very fast internationally. Criminal victims right protection has been highlighted gradually all around the world. Currently, many countries protect criminal victims by government aim, which set by criminal policy. With objectivism development and further merge into international society, starting from 80’s, discussion among academic circle on the necessity and possibility of national judicial aids towards criminal victims occurred in China.In March,2009, together with other 8 government departments, Committee of Political and Legislative Affairs made and printed "Suggestion regarding initiative of criminal victims aids’"which provided the constructive direction for China criminal victims aids policy, yet it’s more policy directional.With more and more criminal victims protection practices, some difficulties and problem on criminal victims aids system exposed in some regions, cities or provinces, but there is no solution on specific issues happened during practice. Therefore, revise and complete the criminal victims aids system becomes very urgent job.This article uses the methods of investigation, research and compare,based on criminal victims aids reality around Yanbian, Jilin Province, concludes and combs criminal victims aids basic principle, work module, standards, financial source, execution as well as analyze the cases during 2001 to 2015, compares with practice on going in other regions and spots out Yanbian local criminal victims aids specialty and shortcomings. Through definite the criminal victims aids system and combine the Yanbian’s reality, to find some issues which needs to improve, further based on "Jilin judicial aids policy" and current Yanbian’s practice, bring up some suggestions towards this policy’s working principal, process and methods.Article divides into 3 parts. First part is introduction, which introduces reason why and how to investigate and research Yanbian’s judicial aids systems and works.Second part, describe the criminal victims aids system and declare Yanbian’s current situation as well as some issues existed. Third parts, bring some personal suggestions towards completion on Jilin’s judicial aids systems and related work.
